1. Privacy of the Affiliate Account: In order to join the P.S. Web Pros Affiliate Program, you will need to provide P.S. Web Pros with an username and password log-in combination. DO NOT REVEAL YOUR LOG-IN INFORMATION TO ANYONE. If you share your log-in information with a third party, we are not responsible for any changes made to your Affiliate Profile and/or the sponsoring Web site by said third party. We also reserve the right to terminate this agreement if we discover that you have shared this information with any third party in violation of this agreement.

2.  You agree and certify that you are of legal age in the state of your residence that you are legally able to bear this contract. You also agree that the taxpayer ID you have given us is valid and that all contact information is current and true. Affiliates are also responsible for keeping the contact information current.

3.  Once P.S. Web Pros (A.K.A. Phoenix Stokes, LLC) accepts this agreement, it will become binding to both parties. Once this agreement becomes binding, you will become an affiliate and in no way will you be considered or deemed as an employee of P.S. Web Pros or Phoenix Stokes, LLC.

4.  No laws pertaining to employees shall be applicable to any affiliate P.S. Web Pros. We will not be responsible for any taxes or contributions or any other laws pertaining to employees.

5.  Employees of P.S. Web Pros or Phoenix Stokes, LLC are not eligible to participate in this affiliate program.

6.  No purchase is necessary to become an affiliate of P.S. Web Pros or Phoenix Stokes, LLC, however commissions are paid on the sale of product only.

7.  P.S. Web Pros agrees to pay a $20-$100 commission on the first of every month with after each fully paid qualified web hosting sale made by a customer referred by the affiliate.  A qualified web hosting sale is the sale of a package for the entire year in advance and at least 30 days has to pass after the purchase before any monies will be sent, due to us offering a 30 day money back guarantee to all customers.  A customer is considered to be “referred by the affiliate” if the customer clicked a banner or link on the affiliate’s web site or through email or customer calls in with affiliate's I.D. Commissions will be paid via PayPal.  You have the option of requesting a check to be sent, in which a $2.50 surcharge fee will be applied for all checks to be cut and mailed. 

8.  You may NOT sell to yourself. Selling to yourself includes but is not limited to ordering an account directly after clicking on your own affiliate banner or link, paying for an account other than your own, placing your contact information on someone else's order form, etc. In other words, you may not sign up as an affiliate and then purchase a hosting account via your own link. If you are caught selling to yourself, your affiliate status will be terminated and you will forfeit any commission. Sales deemed as "sold to yourself" are not considered to be "fully paid qualified web hosting sales" and we will NOT pay any commission on any of these types of sales.

9.  There is never a guarantee of income or other earnings either verbal, written, or implied. All earnings are always based solely on the individual efforts of each and every affiliate.

10.  Affiliates will ONLY be paid on "fully paid qualified web hosting sales" and will not be paid on ANY other sales generated via affiliate referral or link, etc. A "fully paid qualified web hosting sale" is a first time purchase by an individual and/or business.  Affiliates will NOT be paid on ANY AND ALL "Add-On" sales including but not limited to secure servers, shopping carts, domains, ftp, email, extra space, etc. Affiliates will NOT be paid on subsequent purchases made by current customers. In other words, an affiliate can ONLY make a commission on the initial web hosting account purchase from a client. After that, the client becomes client of P.S. Web Pros and is no longer considered a referral if client orders anything more, including but not limited to additional accounts, secure servers, shopping carts, domains, ftp, email, extra space, etc. Affiliates will NOT be paid for the sale of any product other than a web hosting account with P.S. Web Pros.

11. Affiliates are responsible for filing and paying all personal and business income taxes including state, local and federal taxes owed because of bonuses or payments made to you in connection with this program.

12.  Affiliates must represent P.S. Web Pros in a lawful and ethical manner. You must stress the product and not the opportunity. You must only claim or represent what we have as a company provided to you. Any claims by an affiliate that do not reflect what has already been printed or deemed fit by the company will be declared possibly untrue and inaccurate.

13.  Affiliates must treat us with respect. Any attempts to abuse, undermine, slander, libel, threaten, swear at, or cause harm to P.S. Web Pros, one of its customers, employees, or the company directly is strictly prohibited and is grounds for immediate affiliate account termination. In addition, we will pursue all attempts to the fullest extent of the law.

14.  You may only advertise in ways stated and provided by P.S. Web Pros.  Any use of logos or any other copyrighted material is strictly prohibited. You may not make false representations or claims about our services or compensation plan.

15.  You are not allowed to advertise us with any illegal methods, including but not limited to: spamming, Usenet Spamming, Unsolicited Email, Mail Spamming, BBS Spamming, and any other type of spam.

16.  The affiliate may cancel their participation in this program at any time for any reason by simply emailing us at affiliates@pswebpros and providing us with the username and password of your account.

17.  This agreement may be terminated or suspended if a breach of this contract is discovered, or at the sole discretion of P.S. Web Pros. Affiliates found to have violated any or all of the terms herein will forfeit any and all commission, and affiliate status will be terminated.

18.  P.S. Web Pros reserves the right to modify, change, edit, or update the Terms of Service Agreement at any time.  P.S. Web Pros is the sole arbiter regarding affiliate referral disputes and affiliate payments.
